2014 Employee Classification Law

A new law began January 1st addressing the classification of employees versus independent contractors in the construction industry.  As published in our state association journal; this law imposes substantial penalties, cease and desist orders, and debarment orders against employers found to have misclassified employees as independent contractors.  It also imposes individual liability onto corporate officers and agents that “knowingly permit such employer to misclassify its employees.” This does exempt groups that are “responsible bidders” from having to comply with these new requirements. Opponents have raised concerns that the measure is largely targeted at making it more difficult for non-union contractors to win contracts.

It is more important now than ever to properly determine who is an employee and who is truly an independent contractor.  Here is a link to the IRS determination page.

Winter Weather Reminders

As the first winter storm is approaching the Midwest it is important to be prepared when traveling.  You never know when a breakdown or accident could occur; here are a few helpful reminders:

  • Pack an emergency kit in your vehicle including:
    • Flashlight
    • Blanket
    • Warm clothes and hat
    • Boots
    • Small shovel
    • Cell phone charger
  • Inspect your battery to be sure it can handle the cold temperatures.  If it is over three years old, have it tested since they operate at about 50% in extreme temperatures.
  • Check your tire pressure to assure best possible traction.  Cold air causes air pressure to drop since gases contract when they’re cold.
  • Check your antifreeze levels.

One of our most common claims this time of year comes from vehicles sliding into the vehicle in front as they are attempting to stop.  Please allow plenty of time and distance as you approach intersections.

If you do find yourself in an accident, get to the nearest safe place and contact the police.  If you can, take pictures of the damage and trade information with the other driver.

We hope you have a very safe and wonderful holiday season!
